Every provision below is provisional and must be reviewed and finalized by counsel — and the promotion registered/bonded in every state that requires it — before the Daily Spurts Sweepstakes runs. NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN.
The Daily Spurts Sweepstakes (the “Promotion”) is sponsored by [Newthos LLC], [address] (the “Sponsor”).
No purchase or payment of any kind is necessary to enter or win, and a purchase will not improve your chances of winning.Entry is earned solely by completing that day’s free Daily Sheet. A VIP subscription and any other paid feature are for convenience and content only — they never grant eligibility, extra entries, or better odds.
Open only to legal residents of the United States who are at least 18 years old (or the age of majority in their state) at the time of entry. Void in [excluded states — TBD by counsel] and wherever prohibited or restricted by law. Employees of the Sponsor and their immediate families and seeded/house accounts are not eligible. Each entrant must be a single, verified individual (one account, one verified phone).
Each day during the Promotion Period, complete that day’s free Daily Sheet while signed in to an eligible account. Doing so earns you one (1) entryinto that day’s draw. Limit one entry per person per day; completing a Sheet more than once does not create additional entries. A day’s entries close at the end of that day in the furthest-west U.S. zone (Hawaii; UTC-10).
Each day, a fixed prize pool of [approximately $25] is awarded to one or more winners drawn at random from that day’s eligible entrants. The pool may be awarded as a single prize or split into multiple tiers (a few larger prizes plus a number of smaller ones), as posted for that day. Odds of winning depend on the number of eligible entries received that day. Prizes have no cash alternative except as described in these Rules and are credited to the winner’s Spurts prize balance.
After a day closes, winners are selected by a verifiable, seeded random draw. A secret server seed is committed (as a published hash) before the draw; after the draw, the Sponsor publishes the seed so that anyone can confirm the commitment and reproduce the result from the public record. The Sponsor does not choose winners.
Winners are identified by username and credited to their prize balance. Before a first withdrawal, a winner must complete a one-time identity and tax verification. The Sponsor may require a winner to sign an affidavit of eligibility, a liability/publicity release, and an IRS Form W-9 (or W-8 as applicable) before any payout.
All federal, state, and local taxes on prizes are the sole responsibility of the winner. Where required by law, the Sponsor (or its payment processor) will issue an IRS information return (e.g., Form 1099-MISC) and may apply backup withholding if a valid taxpayer identification number is not provided.
Prize balances are held as an account credit. Withdrawals are available at a minimum balance of [$25] via the Sponsor’s licensed payment processor. Balances under the minimum not withdrawn within [365] days may be forfeited, subject to applicable unclaimed-property law.
For the name(s) of the winner(s), recent winners are displayed in-app by username; a written winners list is available on request for [period] after each draw at [request address].
The Sponsor may disqualify any entrant who tampers with the Promotion, violates these Rules or the Fair & Competitive Play Policy, or acts in an unsportsmanlike or disruptive manner. The Promotion is governed by the laws of [state], and is void where prohibited. These Rules are subject to change with notice before any change takes effect.
