Please read these Terms of Service (“Terms”) carefully before using Spurts (“the Service”), operated by Newthos LLC (“we,” “us,” or “our”). By accessing or using the Service — including creating an account, playing daily Sheets, participating in challenges, joining or forming a team, or purchasing a membership — you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to create an account or use the Service. By using Spurts, you represent and warrant that you meet this requirement and that your use of the Service complies with all applicable laws in your jurisdiction.
Spurts is intended for users in the United States. We make no representation that the Service is appropriate or available in other locations. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws.
Spurts is an entertainment-based sports knowledge game. All points, wagers, and rewards within the Service are virtual in nature and have no monetary value. Points cannot be redeemed for cash or cash equivalents. Challenges and point wagers are a game mechanic — they do not constitute gambling, betting, or any form of financial transaction.
No purchase is necessary to participate in Sheets, challenges, or leaderboard competition. A paid membership, where offered, unlocks additional features but does not provide an advantage in scoring, nor does it affect the outcome of any question or challenge.
You may register one account per person. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any suspected unauthorized access.
You must provide accurate information when registering. We reserve the right to suspend or terminate accounts that contain false, misleading, or impersonating information, or that are operated in violation of these Terms.
Each daily Sheet consists of a set of short sports puzzles (“Spurts”) across a variety of game modes. Spurts are played one at a time and lock when answered — once you submit a Spurt you cannot change it or return to it, and timed Spurts lock when their timer expires.
Points are awarded based on correct answers, as determined by our scoring system. We reserve the right to correct scoring errors, void Spurts affected by data inaccuracies or unforeseen events, and adjust standings to maintain competitive integrity. In the event of a void, any associated answers will be excluded from scoring with no penalty.
Monthly and all-time point totals are maintained as game records. They represent in-game standing only and carry no monetary value.
Registered users may send and accept head-to-head challenges. When a wager is agreed upon, the specified point amounts are held from each participant's balance until the challenge is resolved.
Challenge outcomes are determined automatically when the relevant Sheets are graded. The participant with the higher score wins the agreed wager in points. A tied score results in a push — no points change hands. These point transfers are entirely in-game and carry no monetary value.
We reserve the right to void, cancel, or reclassify challenges in the event of a scoring correction, technical error, or confirmed violation of our Fair & Competitive Play Policy.
The Top Dog is an in-game title awarded to the first player to reach the published point threshold in a season. Top Dog challenges — where a player challenges the Top Dog with the Top Dog explicitly on the line — are a game mechanic. The Top Dog carries no monetary value and may be voided, reset, or reassigned at our discretion to preserve fair competition.
Every player is a “Free Agent” until they accept a roster spot. A player designated as a “Team Owner” may form a Team and extend an “offer sheet” to a Free Agent. An offer sheet specifies in-game terms, including a contract length and whether it carries a “drop clause.” Without a drop clause, a Team Owner is committed to the player for the stated term; with one, the Team Owner may release the player at any time. A Free Agent may hold only one active roster position at a time.
Teams, rosters, offer sheets, contract terms, drop clauses, and the Spurts Championship are game mechanics with no monetary value. Offers, signings, and releases are virtual and do not create any employment, agency, contractual, or financial relationship between players, Team Owners, or Newthos LLC, nor any obligation enforceable outside the Service. We may void, reassign, or reset roles, teams, rosters, offers, or Championship standing at our discretion to preserve fair competition.
Spurts offers optional paid memberships (“Pro” or equivalent tiers) that provide access to additional features. Membership fees, billing frequency, and included benefits are disclosed at the point of purchase and may be updated with notice. Payments are processed by a third-party processor; we do not store your full payment card information.
Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings or by contacting us. Refunds are not provided for partial billing periods except as required by applicable law.
You agree not to engage in any conduct that violates our Fair & Competitive Play Policy, including but not limited to: operating multiple accounts; using automated tools or bots to make picks; colluding with other players to manipulate standings or challenge outcomes; exploiting bugs or timing loopholes; or harassing, threatening, or targeting other users.
You also agree not to attempt to access, reverse-engineer, scrape, or interfere with any part of the Service or its underlying infrastructure.
You may submit content through the Service, including trash talk posts and profile information (“User Content”). You retain ownership of your User Content, but by submitting it you grant Newthos LLC a non-exclusive, royalty-free, worldwide license to display, distribute, and use that content in connection with operating the Service.
You agree not to post content that is unlawful, harassing, defamatory, obscene, or that infringes the intellectual property rights of others. We may remove any User Content at our discretion without notice.
All content, design, trademarks, and functionality of the Service — excluding User Content — are the property of Newthos LLC or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without express written permission.
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
Sports results, scores, and statistical data displayed in the Service are sourced from third parties. We are not responsible for inaccuracies in that data, though we will make reasonable efforts to correct any errors that affect scoring.
Spurts is independent and is not affiliated with, endorsed by, or sponsored by any sports league, team, media company, sportsbook, or player association. Questions may reference real leagues, teams, players, games, records, and statistics for purposes of identification, commentary, and entertainment. All such names, marks, and logos remain the property of their respective owners.
To the maximum extent permitted by applicable law, Newthos LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service — including loss of data, points, standings, or virtual items — even if advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to the Service shall not exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim, or (b) fifty dollars ($50).
You agree to indemnify, defend, and hold harmless Newthos LLC and its affiliates, officers, employees, and agents from any claim, liability, damage, or expense (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.
We reserve the right to suspend or permanently terminate your account at any time, with or without notice, for violation of these Terms or our Fair & Competitive Play Policy, or for any conduct we determine to be harmful to the Service or its users. You may delete your account at any time through your account settings.
Upon termination, your access to the Service ends. Points, standings, and challenge records associated with a terminated account may be voided or removed at our discretion.
These Terms are governed by the laws of the state in which Newthos LLC is registered, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be resolved through binding arbitration on an individual basis — you waive the right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.
We may update these Terms from time to time. We will post the revised Terms with an updated effective date. Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the changes. If you disagree with any changes, your remedy is to stop using the Service and delete your account.
