Effective August 14, 2026. These Terms govern your use of SPURTS. We update them from time to time; the date above always tells you which version is current.
Please read these Terms of Service (“Terms”) before using SPURTS (“the Service”), operated by Newthos LLC (“we,” “us,” or “our”). By accessing or using the Service — including creating an account or playing any part of a Daily Drop — you agree to be bound by these Terms. If you do not agree, do not use the Service.
The short version
You are not betting. There is nothing to stake, nothing to lose, and no wager anywhere in this app. You are calling shots and keeping the receipts.
SPURTS is an entertainment product built on sports knowledge and judgment. SPURTS is not gambling, sports betting, a sportsbook, a daily-fantasy contest, or a prediction market, and nothing in the Service is a bet, stake, or wager. You cannot deposit money, stake anything of value on an outcome, or lose money by playing.
No purchase is necessary to play, compete, or rank, and no payment buys, increases, or improves any score, ranking, or standing. An optional subscription removes advertising and adds convenience and cosmetic features — see Section 7 for exactly what it does and does not do.
The short version
18 or over, in the United States. That is the whole list.
You must be at least 18 years of age (or the age of majority in your state, whichever is greater) to create an account or use the Service. By using SPURTS you represent and warrant that you meet this requirement.
SPURTS is offered only to individuals located in the United States. We make no representation that the Service is appropriate or available anywhere else, and access from outside the United States is not authorized. You are responsible for compliance with the laws of your jurisdiction, and we may verify or restrict eligibility, including by location.
The short version
One account per person, no password to forget, and you are on the hook for what happens under your name.
You may register one account per person. SPURTS accounts are passwordless: you sign in with a one-time code sent to your email address, or through a supported sign-in provider (such as Google). You may optionally add a mobile phone number to your account — if you do, SPURTS may text that number account and service messages (such as sign-in codes); marketing texts are sent only with your separate, optional opt-in, as described in the Privacy Policy’s Communications & SMS Consent section and on our SMS / Text Messaging Consent page. You must provide your date of birth at signup so we can confirm you are 18 or older.
You are responsible for keeping access to your sign-in email (and any linked phone number or provider account) secure, and for all activity under your account. Notify us immediately of any suspected unauthorized access.
You must provide accurate information. We reserve the right to suspend or terminate accounts that contain false, misleading, or impersonating information, that are duplicates, or that are operated in violation of these Terms or our Fair & Competitive Play Policy.
The short version
One Drop a day, put together by a human. It is not a fixed number of anything — some days are fat, some days are lean, and that is the point. Miss one? The archive is open.
The Daily Dropis the day’s edition on the feed: a curated set of items an editor has programmed for that date. Its contents and its size vary by day at our editorial discretion, and we do not promise any particular number or type of items on any given day. Some days may have no Drop at all.
Past days may remain available to play. Where they are, you may return to a previous day’s Drop and play items you have not already played, subject to each item’s availability window and to whether its result has been published. Items you cannot play can still be viewed. We may change how far back the archive reaches, and may close any item’s window, at any time.
Play is one-and-done. Once you submit an answer or a take on an item it locks — you cannot change it, replay it, or improve it. Timed items lock when their timer expires. You may revisit a played item only to see your result and the community response.
The short version
Three numbers, none of them money. Sparks are points, SPURTS IQ is the long record, and your Opinions Score is what the room makes of your takes. You cannot buy any of them, and you cannot cash any of them out.
Play anywhere on the feed may contribute to any of the following, as declared on the item:
Sparks, SPURTS IQ, and Opinions Score are game records only. They are not money, currency, or a cash equivalent. They have no monetary value, cannot be purchased, cannot be transferred between players, and cannot be redeemed, cashed out, or exchanged for anything of value.
Points, ratings, standings, and leaderboards are game records only. We reserve the right to correct scoring errors, void items affected by data inaccuracies or unforeseen events, and adjust standings to maintain competitive integrity. Voided answers are excluded from scoring with no penalty. Where an item’s outcome is settled by an editorial ruling, that ruling is final for scoring purposes.
The short version
There is no prize program right now. Nothing you do in the app is an entry into anything, and there is no money to win. If that ever changes, you will see real rules before it does.
Not currently running
SPURTS is not currently running any prize, sweepstakes, contest, or giveaway. There is no entry, no drawing, no prize balance, no withdrawal, and nothing of monetary value to be won through the Service. No part of play is an entry into any promotion.
If we introduce a prize promotion in the future, it will be governed by its own published official rules, which will state the sponsor, eligibility, entry method, entry period, prize description and value, odds, winner selection and notification, and any alternate free method of entry. Any such promotion will be free to enter, and no payment will ever buy, add to, or improve an entry or a chance to win. Nothing in these Terms creates a right to a prize, and no promotion is offered until its official rules are published.
The short version
Ads pay for this. You can pay a little to turn them off, and that is all paying does — it buys you quiet, never an edge. Every competitive part of SPURTS is free.
The Service is supported by advertising, served with the help of advertising partners including Google, on the web and in the Play Spurts mobile app. How advertising works, and the privacy choices you have about it, are described in the Privacy Policy.
SPURTS also offers an optional paid subscription. Its price, billing frequency, renewal terms, and any free-trial terms are disclosed at the point of purchase before you are charged. Payments are processed by a third-party payment provider; we do not store your full payment card information. A subscription renews automatically each billing period unless cancelled before the renewal date, you may cancel at any time through your account settings, and refunds are not provided for partial billing periods except as required by applicable law.
The subscription buys convenience and cosmetic features only — principally the removal of advertising. It does not buy, increase, or improve any score, ranking, standing, eligibility, or competitive advantage of any kind; it does not affect Sparks, SPURTS IQ, or Opinions Score; and it is never a condition of participating in any promotion, nor does it ever grant, add to, or improve an entry or a chance to win. Every competitive surface of the Service is available without payment.
The short version
Play it straight. One account, your own brain, no scripts, no ganging up, and do not be cruel to people.
You agree not to engage in any conduct that violates our Fair & Competitive Play Policy, including but not limited to: operating multiple accounts; using automated tools, scripts, or bots to play items or interact with the Service; colluding with other players to manipulate standings or ratings; exploiting bugs or timing loopholes; or harassing, threatening, or targeting other users.
You also agree not to attempt to access, reverse-engineer, scrape, or interfere with any part of the Service or its underlying infrastructure.
The short version
Not every name in here is a person. We run our own accounts so a brand-new app does not feel like an empty room. They can show up on boards and in the comments — they can never take a prize, and they never cost you a thing.
SPURTS operates accounts that are not real players. These include test, demonstration, editorial, and automatically generated accounts whose activity is produced by us — including by automated processes running on a schedule — rather than by an individual user.
Such accounts appear in public-facing parts of the Service, and may do so alongside real players without being individually labelled. This includes leaderboards, rankings and standings, participation and player counts, and community activity such as posted takes, comments, and upvotes. We do not represent that every name, take, vote, or count shown in the Service corresponds to an individual human player.
Accounts operated by SPURTS are excluded from any prize, promotion, drawing, or payout of any kind, and from the selection of any winner. Their activity does not reduce, dilute, or otherwise take anything from the Sparks, SPURTS IQ, or Opinions Score you earn through your own play, though — because SPURTS IQ and Opinions Score are calculated relative to the whole field — simulated activity forms part of the field those ratings are measured against.
We may add, remove, or change these accounts, and may include them in or exclude them from any display, at our discretion.
The short version
Your takes stay yours. We just need permission to show them in the app.
You may submit content through the Service, including answers, opinions, posts, and profile information (“User Content”). You retain ownership of your User Content, but by submitting it you grant Newthos LLC a non-exclusive, royalty-free, worldwide license to display, distribute, and use that content in connection with operating the Service.
You agree not to post content that is unlawful, harassing, defamatory, obscene, or that infringes the intellectual property rights of others. We may remove any User Content at our discretion without notice.
All content, design, trademarks, and functionality of the Service — excluding User Content — are the property of Newthos LLC or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without express written permission.
The short version
We built this carefully, but we are not promising it is perfect, and we are not affiliated with any league or team.
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
Sports results, scores, and statistical data displayed in the Service are sourced from third parties. We are not responsible for inaccuracies in that data, though we will make reasonable efforts to correct errors that affect scoring.
SPURTS is independent and is not affiliated with, endorsed by, or sponsored by any sports league, team, media company, sportsbook, or player association. Content may reference real leagues, teams, players, games, records, and statistics for purposes of identification, commentary, and entertainment. All such names, marks, and logos remain the property of their respective owners.
To the maximum extent permitted by applicable law, Newthos LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service — including loss of data, Sparks, ratings, or standings — even if advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to the Service shall not exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim, or (b) fifty dollars ($50).
You agree to indemnify, defend, and hold harmless Newthos LLC and its affiliates, officers, employees, and agents from any claim, liability, damage, or expense (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.
We reserve the right to suspend or permanently terminate your account at any time, with or without notice, for violation of these Terms or our Fair & Competitive Play Policy, or for any conduct we determine to be harmful to the Service or its users. You may delete your account at any time through your account settings.
Upon termination, your access to the Service ends, and Sparks, ratings, and standings carry no value and may be removed.
These Terms are governed by the laws of the state in which Newthos LLC is registered, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be resolved through binding arbitration on an individual basis — you waive the right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.
We may update these Terms from time to time. We will post the revised Terms with an updated effective date. Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the changes. If you disagree with any changes, your remedy is to stop using the Service and delete your account.
